Legal Question in Landlord & Tenant Law in California

I live in San Francisco, CA. I've been living in my apt since Nov 2009. I've paid rent on time. On Dec 2010 my landlord needed to paint and put in new carpeting so my landlord said I had to leave but the temporary room they offered was not habitabal. I got a hotel room and was going to deduct from the rent....when I did it they got upset and is suing me for eviction because they say I "owe" for deducting from the Jan 2011 rent. Also, I verbally told the landlord in Nov 2010 that I was gettting a roommate which the landlord was fine with it now but now they are claiming I can't! They started the process with the courts to evict me. I have filed paperwork as well. I need advice please....

First, depending on where you live in San Franciso, you may or may not be covered by some rather unique housing laws in that area. I strongly suggest you contact a tenant rights attorney (there are a ton in the bay area) and discuss the case with them. It may make sense to hire someone to defend this suit as it would appear that the landlord was being unreasonable with respect to the relocation issue. As for the roommate, you may not prevail on that point unless you obtained written approval from the landlord for the roommate. Because of the unique nature of rental housing law in the Bay Area, you really need to consult with a local tenant attorney up there. Good luck.
