Legal Question in Landlord & Tenant Law in California

Neighbor is suing landlord, so landlord is suing me.

I (and my father)are being sued by my landlord for $5000. He claims it is because the woman who lives in the apartment below me is suing him, claiming I make too much noise.

My father co-signed my lease agreement (by mail), and he lives in San Francisco. They only served me. (Improperly)

They have not even lost the suit, nor have they tried to evict me for noise (I am a good paying tenant, always on time)

Should we claim the suit is in the wrong venue, since my father does not reside in Los Angeles, and did not sign the lease here? If only I appear at court, will we lose?

Additionally, the women below me is making my life hell, calling the cops constantly, to the point I am afraid to walk on my floor. The cops are sick of her, too. This is lawsuit is so ridiculous, how do I get her to stop? She won't even talk to me, she just bangs on the ceiling and calls the cops. Now she is suing the landlord, so now he's suing me. What do I do?

You have to answer the complaint. The proper venue is here. Regarding your father, he just guaranteed your rent payments. I'd have to see the guaranty to determine whether he is liable for a nuisance. The tenant below you has to be dealt with, and your landlord has to address the noise problem. You should get an attorney. If you'd like, I can give you a consultation at no charge. Call me if you'd like. (310) 806-9237. Good luck, ---Phil
