Legal Question in Landlord & Tenant Law in California

Personal property Contract

We(my husband and I) were in joint ownership of a property with a third party. In Dec. 2003 we bought out the third party with a provision he could take the kitchen appliances which were his property. We made an offer to buy said appliances and were rejected. This property is a rental property and has been occupied .The third party has never made any attempt to respond to us or remove the appliances in 3 yrs. Now in Oct.2006 the third party wants the appliances. Are they still legally his?

Re: Personal property Contract

His failure to obtain the items could be viewed as a waiver and his right to them extinguished. You must decide if you wish to fight him over the items or not.
