Personal Property

My ex-fiance left some personal possessions at my house. He left me a text message saying he'd get the items soon, but he never said exactly when. It's been five months! I want to give him a deadline, so I can get rid of this junk. How much time do I need to give him?

Civil Code Section 1985 provides you with the form and the time line to dispose of personal property. It must be in writing per the Code, and you must give him 18 days notice if the notice is deposited in the mail. In counting the 18 days (it's 15 days if it is personally served), you don't count the day it's deposited in the mail, but you do count the last day unless it's a Sat., Sun. or holiday; if one of those three exceptions it goes to the next working day for his pickup of the personal property.

Fifteen days, and then property is considered "abandoned".

So give him 15 days.
