Renter Not payint rent

I have rented out one of my rooms for over a year and have decided to no longer rent. We originally did a 6 month contract and since then it has been a month to month rental. I gave the tenant 60 days notice. She later told me that she should would not pay this month's rent because she was paying an extra 25 dollars for the past few months and that would cover half the rent. (She did volunteer the 25, but it was to help cover Utility Bills). I then asked her if she was planning on paying the other half. She said ''no'', because my lawyer said I may not have to because I am disabled and may be able to live in your house for free. My question: I am in California. How long do I have to wait until I issue a 3 day notice to pay or move out? Can I issue one? Does she have a right to consider the extra 25 dollars as rent money? The increase was never put in writing. And...is it possible for her to live in my house for free?

Nobody gets to live for free. Give her the 3 day notice now.
