Legal Question in Landlord & Tenant Law in California

My roommate won't leave. He never paid his rent on time and when he eventually did, it wasn't even close to being the full amount due. I gave him thirty days notice and he hasn't packed any of his things to leave and the thirty days was up over a week ago. He refused to sign the lease but he did change his address, so technically he does have residency and can use that against me. What can I do legally to get this scumbag out?

File the unlawful detainer using his address that's on the notice. If there's a dispute about possession, let the court decide that issue either by way of a motion for summary judgment or trial. You might take photos of mail to him at your address to use as evidence of his continued possession of the premises.
