Legal Question in Landlord & Tenant Law in California

One of my tenants (male) got married.

If I accept a rent check with his wife's name on it, does that mean I acknowledge that she is a tenant, even though her name is not on a Rental Agmt?

I disagree with Mr. Tashjian. The fact that you know someone is on your property does not make them a tenant, or acknowledge their tenancy. Occupation of property with the consent of the landlord in exchange for rent is what creates a tenancy.

But you have a different issue here altogether. You seem to think that you can refuse to allow someone's wife to live in the rental unit. California law prohibits discrimination based on family status. I suggest you take any written lease agreement that you have with this tenant and consult with a knowledgeable attorney before taking any drastic steps.
