Legal Question in Medical Malpractice in California

My Husband and Daughter are in the midst of braces. The orthodontist has been out of the office for over 90 days. He was supposed to be back this week. We received an email from him on Tuesday stating he is closing his office and gave us another ortho's number. In speaking to the "new" ortho none of our previous payments will transfer over. We had paid in full almost $3000 for my husband and our portion for my daughter. Is there any recourse? I know quite a few of his patients and we are sick about this. He just took our money and now we will have to pay for my daughter to get her braces off and her retainers and the same for my husband who has a bit of treatment left. What can we do? Thank you.

Take him to small claims court for breach of contract.

You can sue the dentist for what he did not deliver; you may also want to contact the California Dental Board. If yo can get all the patients together you may be able to sue together.
