Legal Question in Personal Injury in California

After 2 settlement hearings I feel like my attorney and the opposing attorneys and the mediation Judge all want me to settle, After 2 years and 3 surgeries my bills are over 70k and the owner of this slum house who told me she would make it safe and the property manager said she would as well. 70k pays my bills, and thats it after the gross negligence, and the property manager lied and said I never told her to fix the hand rail that came out of the wall and caused my fall. My shoulder will never be the same, I cant throw a baseball or football.

I say I take it to trial and I get the feeling I have nothing to lose. What are the odds I go to trail and they settle the day before for 25-30% more?

I'm not sure if I understood your question here. Are you being told to settle the case for $70k? If so, you should discuss with your lawyer why he or she is recommending settlement that will just pay your medical bills. Perhaps he or she is not a trial lawyer and is intimidated? Perhaps there are good reasons for the recommendation. Be that as it may, you have the right to get second opinion which you should consider doing.

As for your comment about bk, if you meant filing for bankruptcy make sure to consult your lawyer and a lawyer who does bankruptcies. One thing you should know is if you file for a bankruptcy your accident case will become an asset of the estate and the trustee will be in charge of it.
