Legal Question in Personal Injury in California

21 year old daughter was in a traffic accident 1/10. Accident was other drivers fault. Daughter is injured. Have exhausted my $1000 medical benefits daughter still needs care. My insurance is mercury, other parties insurance is mercury. Feels like mercury is taking care of themselves. Will I be treated fairly to take care of my daughter's back issues down the road or do I need an attorney to make certain that someone is looking out for my daughter? Help!

What has she been doing these 8 months since the accident? Mercury is the worst. She will not be treated fairly. Have her retain an attorney. Watch out for legal time limits -- your run-out-the-clock offense isn't working.

I have dealt with Mercury many times and you cannot trust that company to be fair. I worked at Farmers Insurance Claims for many years before I became an attorney and I can say that Mercury does not care about claimants. You should seek the advise of an attorney. If your policy as medical coverage or underinsured motorist coverage [if the other driver's policy turns out to be inadequate to cover all of your daughter's medical expenses. loss of earnings (if any) plus pain and suffering damages] you can go after those benefits if you recover the full policy limits of the other driver's policy. I cannot say what the value of your daughter's claim is as kyou have not provided enough information to evaluate it and it may be premature to make that determination at this time. I hope this helps.
