Legal Question in Personal Injury in California

My dad got in an car accident on 12/16/2010.

This woman ran in to my dad and it ended up being his fault because he was in the center divider and she ran in to him and hit his left rear truck bed/tire.

The insurance settled with her at the time however now she is sueing for personal injury stating she was stopped at a red light and was rear ended by my dad causing injury and damages. However thats not what happened the truck was totaled and they could not replace the bed of the truck because of the damages when she hit him and there was no injurys to my dad and my dad

80 years old. She had seven other people in the car and no one got hurt but her.

My dad only has Social Security and doesn't want to wreck his credit what should he do?

If the case was 'settled' by the insurance company, there was a settlement agreement that bars any lawsuit by her. Turn this over to the insurance company immediately. They are responsible for handling it, and taking all legal action necessary.
