Legal Question in Personal Injury in California

My dog was attacked in an empty lot next door from my home by the neighbors dog. The dog bit my dog pretty badly, she has 6-8 puncture wounds and I'm sure i need to take her to the vet. This is not the first time the neighbors dog has attacked/injured another animal. How should i approach my neighbor about the incident ?

While on the face of it, it would seem that the owner of the dog that bit your dog would be liable for your dog's vet bills. However, based upon the facts you presented, it might appear that your dog was not on a leash, and it doesn't appear that the other dog was on a leash either. If i am correct, you might have a difficult time getting the court to find in your favor since your hands are unclean.

I would definitely consider filing an action in small claims court, but before you do, there might be another avenue to take. There are some lawyers who actually specialize in animal issues. I believe this area of law is emerging. It might be worth it for you to google attorneys specializing in animal rights.
