I worked on a similar matter. In california, generally, if you are rear ended, the person who rear ended you is responsible. She has to let her insurance know so they can defend. If they do not provide you with an attorney in time to respond to the complaint, 30 days from when your mother in law received the papers, you have to hire an attorney and respond. Turn the matter over to your mother's insurance company. They will defend you and your mother. It does not matter that you had no driver's license.

Mr. Kuhn is correct. Your mother's insurance company has a duty to defend.
