Legal Question in Personal Injury in California

My mom hit a guy with my dads truck, the trucks insurance was under my dads name only.. does the other guy have the right to sew my mom without any notice? what if my mom cannot pay what it is the guy is sewing us for??

First check to make sure that she is not covered by the motor vehicle insurance. Then check with his homeowner's insurance. The passengers, driver and owner of the other vehicle can sue her without notice. If she is sued notify the auto insurance carrier and retain an attorney to represent her. The attorney can review the facts and advise you as to the options available to the family.

Car insurance follows the car. Your mother is insured under the truck's insurance as a permissive user. The other driver can sue for personal injuries and damages without any notice. There is a 2 year statute of limitations to sue for personal injuries in California.

You should turn the lawsuit over to your father's insurance company and they will provide a defense and pay up to the limits of the policy.
