Legal Question in Personal Injury in California

Nightmare

Auto accident in CA in 10/06. Default judgement in 10/07. The other party 1st siad they didn't have an insured by that name, now they are defending them. My attorney removed himself from my case 6/5. Now the other party wants interogatories by 7/1. Mediation is supposed to be completed by 6/16. What am I supposed to do? I can't possibly complete anything by Tuesday, when I do not know wha they are asking for.

Re: Nightmare

You will have to ask for an extension of time to answer the questions if you can not do it by the due date. If you do not get an extension, they will file a motion to compel and eventually get monetary sanctions against you and possibly get your complaint dismissed. Why did your attorney withdraw?

Re: Nightmare

If you intend to represent yourself in this, feel free to contact the other side's attorney and work out an agreed resolution or continuance of the proceedings, if possible. You might have to seek a court order for extension of time, for good cause.

You'd probably be better off getting a new attorney who knows what to do and how. He'll have to immediately seek a continuance from the other side and court. If this is in SoCal courts, and you're serious about doing so, feel free to contact me to discuss the merit and value of your case.
