Legal Question in Personal Injury in California

I have a personal injury case in California. I was recently referred to a second attorney by my original attorney, however, I am extremely dissatisfied with my new attorney. He is EXTREMELY rude and unprofessional. There has not been a settlement yet, and he has not done any work on my case other than mailing me a retainer agreement. If I fire him, will I owe him any money?

The answer to your question depends on whether you guys are on the same page about the amount of work he has done and whether or not you have any obligation toward him. You should first discuss switching attorneys with him, specifically - whether he plans to assert a lien against the case and then make any decisions based on that.

1. The new lawyer has no obligation to do any work on your case without you first surfing the retainer agreement. So, unless you first agree to hire him he doesn't have to do a thing.

2. You don't have to hire the second lawyer if you don't feel comfortable with him. The choice is yours.
