Legal Question in Personal Injury in California

I was rear ended by someone with faulty brakes. She claimed that a friend worked on her brakes. She told her friend that morning her brakes did not feel right, he told her to drive the car and the brakes with automatically adjust. I was stopped at a signal light and she hit me twice. Less than $1k damage but I have been seeking medical attention for a strained neck. Should I hire an attorney?

Yes, mainly because of the low property damage--that is, IF you can find an attorney to take the case. Insurance companies on low-damage accidents will routinely deny medical payments for treatment beyond a couple weeks, or maybe even altogether. If you happen to have suffered a serious injury, you will have to fight hard to get compensation. Without an attorney, you will not be able to file a lawsuit, and without that threat you will have no real leverage.

The decision as always, must abe your own. That being said, insurance companies are tougher with claimant who were in a low or minor impact damge case with limited injuries. They deny claims that should not be denied or they may make a "low ball" offer to settle the case I used to be in claims so I know. I handle personal injury claims for individuals now. But, not every case is one to litigate either. Do not over treat. But do not delay in seeing a medical provider either as this will be used against you later. If you know an attorney that you feel good about and trust contact that person and explain all of the facts, what exactely happened, what injuries or pain you have experienced and when you first went to the doctor.
