Hi

l own a 3 bedroom Duplex property in Los Angeles under rent control. i have not raised the rent for 3 years and the current tenants only 1 is on the original agreement. i understand as l have excepted checks from these people l have excepted them as tenants. Now 1 has left and the currents tenants want to move another person in, which l have refused until we have a new agreement that we are both happy with. The current area rental value is $2800+ they are paying $2200 l have asked that we agree on $2400 is this within my rights not to allow them to have a subtenant and a fair increase in price considering l have not raised for 3 years?

If your property is subject to rent control, then you are only allowed a rent increase of a certain percentage each year. The fact that you did not increase for the last 3 years will not help you. You can only increase at the percentage based on the 2200. As for what percentage you are allowed, check with the local rent control board - 2400 may be okay, but you need to make sure.
