Legal Question in Real Estate Law in California

I live in a condo and have applied for installation of a (small ductless) air conditioner with our HOA. Do they have the right to say no even if the specs., size and location if the unit is within the criteria of the City Planning Department?

Yes. Condo associations are not limited to enforcing building codes. Most condo HOA governing documents give the HOA FAR more control over modifications to the units than just applying the building codes. Read your CC&Rs; and any By-Laws of the HOA for more information.
