Legal Question in Real Estate Law in California

During our modification 2 1/2 years ago, our mortgage lender verbally agreed to pay all outstanding land taxes plus land fees (we live on Indian land & pay lease fees).

Subsequently, the BIA returned paid fees to mortgage lender.

After much time and effort on my part the bank finally paid all land fees, but they are charging All of this amount to my escrow balance (to the tune of $38,000.).

Do I have any recourse with my lender?

I'd say whatever is in the written loan agreement would prevail over any oral agreement made by an employee of the lender. What's in the writing?
