property lines

my neighbor has moved out and has a realtor selling home. The privacy fence was blown down. When I had two estimates done the estimator noticed that a tree had been planted near the property line and had grown enough to damage the fence and compromise the property line when building another fence. I called the realtor and she has not responded. I asked her to get the owner's permission to cut the tree down. I'm not sure what recourse I have.

I already responded to what appears to be a duplicate question. The only thing I can add at this point is that a blown-down fence will be a problem for the seller and the Realtor alike, as it will detract from the presentability of the property that's for sale in a tough market. So, if she doesn't respond soon, try to visit her in person to discuss a solution. When that happens, keep in mind the substance of my other answer.
