Legal Question in Real Estate Law in California

I received a full reconveyance on my property in Feb 2012. I just noticed that a rescission of the reconveyance has been filed. They say that the reconveyance was done in error. Is there a statue of limitations on rescission?

Rescission is a legal remedy and your answer depends on the circumstances. It appears the mortgage company had made a mistake in the payoff amount. Their negligence is not a prerequisite to the remedy, and rescission is generally granted so long as there was a mistake. However there may be other arguments to be made fraud etc. Let me know if you decide to get serious about meeting a real estate attorney 818 688 2225.

Good luck
