Legal Question in Real Estate Law in California

I sold my vehicle to a guy. I let him register the vehicle, but I kept myself as the legal owner on the title. The written agreement was to pay me $1600.00 for the vehicle in installments. He stopped paying me 2 months ago. He is currently in jail for two counts of being in possession of vehicles that aren't his. My truck is at his friends house, in his driveway. The problem is the friend will not let me on to his property to get my vehicle. I already canceled the sale through the DMV. I don't know how to proceed. Hi friend wants me to pay him for storing the vehicle at his house. When in fact his friend had it parked there because he also blow the engine. I just need to know what steps I need to take to get my vehicle back with out any legal issues.

Do you have the Judgment/Conviction that sent him to jail? I'd start with calling the police, actually it would be better to go to the station with the Judgment/Conviction and tell them the story. You are obviously going to need to set up a date and time with the police to go over and recover your vehicle since you will obviously need a tow truck. Remember, technically this person has received stolen property.

Mr. Linden's advice is good, and if the police don't show much interest in moving quickly, you might also consider contacting a couple of repo companies and see whether they can do a legal repo for you on the strength of your story and your documentary evidence.
