A oral contract is as binding as a written contract, and you wouldn't be the first person involved with a dishonest family member. (Main difference is that it is easier to prove a written contract).

You almost certainly need the help of an attorney, If I can answer any more questions, you may e-mail, or call my office.

Good luck!

You definitely have a case. The first question I would ask as an attorney is "What is your GOAL?" Do you want to try to force your brother to honor the contract or is the priority getting money back? You may want to put a lis pendens on the property (notice that there is a legal action pending) so that your brother cannot sell to someone else while you get this dispute figured out. You are invited to call and chat further about the situation.
