a woman already owns a house. she marries a man and is married for 30 yrs. (in California) she decides to make a will and give the house to her children from a different marriage. what legal rights does the husband have in regard to the house???she died and the kids want to sell the house and kick the husband out.....

To the extent that community earnings or time were spent to enhance the value of the house, there is a community element. This is what the fights in divorces are about when counsel argue what is community and what is separate. Did the husbands money go to pay taxes, mortgage or improvements? Were joint earnings used for theiis purpose. DId they build the addition with joint funds? Seek an estate administration attorney.
