Legal Question in Sexual Harassment in California

Harrassment

My boss bullies and speaks to me and another employee, another Armenia woman, in a condescending manner and raises her voice to us. Would that be considered harrassment? I have documented everything and complained to the owner previously in regards to this and work related stress. He said that I should not take it personally and it's just business. He told me that we aren't here to make friends or be polite and we are here to get the job done. I had asked to move to another unit but was told that it would not be the best thing at this point. I reported another incident to Human Resources just recently where my boss was bullying me, put me down and intimidated me. That night I was so upset I couldn't sleep. I had aweful back aches and stomach aches. The next day I called in sick and advised how I was feeling due to stress. My doctor then recommended I take 2 weeks off from work due to stress amd she faxed over a note the next Monday. Please let me know your thoughts. Thank You

Unless you can show that he has selected you and the other Armenian woman for special treatment, and does not yell at other non-Armenian woman, then you have a garden variety jerk for a boss. You might have a claim for workers comp if that is the case. Talk to a workers comp lawyer if the stress is unbearable. Unfortunately, there's no law that bars a supervisor from being a loudmouth.
