Minor Child - Sexual Harassment

My daughter will turn 18 yrs of age in less than 2 weeks. She as a minor, worked for a Sport Center in which she was sexually harassed; touching, suggestive offers, visits to MY home, his emailling her, requests for her to wear revealing clothing, and to bring in cute, pretty friends to seek employment as well.

I don't know how or where to begin the process of filing a complaint against the individual/and or firm. Are there certain things which must be done prior to any suit since she is still a minor?

Please help me. If this is happening to my daughter, how many other young girls can this be happening to? Thank You

Most lawyers would want to conduct an investigation before taking any action, to gather as much evidence as possible. Then, "demand" letters are often written to the company to seek corrective action and compensation for the harm done. Sometimes, internal complaints are filed also, following company procedure.

The matter can be taken to an outside agency, such as the California Department of Fair Employment and Housing or the U.S. Equal Employment Opportunity Commission, for a complaint and investigation.

If a lawsuit is deemed appropriate, you will probably have to be named as her guardian, since minors cannot sue for damages on their own.

Whatever you do, you should first schedule an appointment with an experienced employment law attorney in your area to review the case and give you better advise than the general information we can give you here.

No employee of any age should be subjected to such conduct. Your daughter has a claim. Rather than trying to do it yourself, she should retain an exerienced employment laywer to represent her. If you are in the Southern California area, feel free to call for a more detailed analysis.

She needs to document it, and more importantly, should be formally complaining to management in writing, since the company is not liable unless they are on notice of the problem. Have her contact me if interested in discussing her rights and the remedies available.
