1) The Fair Employment and Housing Commission regulations define sexual harassment as unwanted sexual advances, or visual, verbal or physical conduct of a sexual nature. This definition includes many forms of offensive behavior and includes gender-based harassment of a person of the same sex as the harasser.

2) How can such an act be done without ur consent has to be proved.

I suppose there could be a battery there somewhere, but the question remains; how much money would a masseuse have to pay a judgement? My only advice is forget about the headache of litigation and simply avoid going back.
