Legal Question in Social Security Law in California

Mishandling of Social Security Disability Case

My husband who is amputie and is unable to work was suggested by one his doctors to apply for Social Security Disability. Since it was such and cut and dry case the doctor said to go to a large name disability law firm ''as seen on TV''. Through their mishandling from the start, which I believe to raise their fee he has been totally denied and they no long will handle the case. We have sold property and depleted an IRA account to live. When he finally wins his case which I no he will with other help, can we sue them for damages Thank you for your help.

Re: Mishandling of Social Security Disability Case

Depending on the error alleged since great majority of SS cases are won on the ALJ hearing level and not on initial application.

Your inquiry is very fact specific and is not something any lawyer can answer without having done a complete review of the file.

Lastly, these nationally recognized law firms who claim that "they can deal with the government, because you have enough to worry about" usually contract out cases or will delegate otherwise non-delegable duties without adequate disclosures or consent. Something to look into!

Hope this helps and good luck.
