Legal Question in Tax Law in California

Tax concerns

In early 2000, we consulted a tax person(mid-size firm) who specialize in solving IRS problems. At the time we owed about $20,000 in back taxes and penalties. Our income was approx. $36,000 per year.

We were told for about $3,000 he would make it go away. We filled out the offer and compromise shortly thereafter. A few months later the tax person said the IRS claim they didn't have 1 yr of our returns. Later they found out that they did have it, but the system ''kick out'' the offer and compromise and started process all over. Now it's 2002, and our income has increased, and our offer has been rejected and now we owe $40,000 in addition to $3000 we already paid. Feels like the $3,000 was for nothing and now we're worse off than when we started. Lost confidence in this compamy. Would this be considered malpractice and is there anything that can be done?

I do malpractice and Tax Dispute Resolution and while there MIGHT be errors by the firm, there may not have been. In any event it is probably a case that does not warrant a lawsuit, in my opinion.
