Legal Question in Wills and Trusts in California

1. decedent left no will

2. he has a surviving spouse

3. He has five surviving children

4. the property was purchased while they were married in california

The question is do the surviving children get his half of the property?

First you need to know exactly how title to the property was held. Second, you need to know whether it was community or separate property. Once you have made those determinations, check Cal Probate Code Section 6401.
