My Dad died recently; there is checking account with my name, my older brother and my dad; my brother took out fifty thousand dollars after my Dad died, can brother do this? is he legally entitled to this money?; Can I sue my brother?

This is what can happen when people use informal "estate planning" like this. If his name was on the account, then the withdrawal was legal and the bank is not responsible.

As for your second question, yes you can sue your brother since you became co-owners of the account and he took more than his fair share.
