Legal Question in Wills and Trusts in California

My mother passed recently and was a resident of California; my brother and sister who resides in California is claiming to be the sole heirs to our mother's estate. My mother did not have a will nor did she appoint a legal guardian over her estate. What recourse do the other siblings living in a different state have to prevent the siblings in California from taken everything and not dividing the estate equally among all my mother's children.

I am sorry for your loss.

Do you know what made up your mother's estate when she died? Did she own a home, have life insurance, have a retirement account? Depending on what her estate consisted of, your recourse may vary.

I strongly suggest you contact a probate litigation attorney in the area where your mother last lived and discuss your options with the attorney. There may be deadlines that need to be addressed immediately.

If you cannot locate an attorney, I would be happy to provide a referral. Or, you can call the California State Bar for a referral.

You can start by filing a request for special notice with the probate court so you know what is going on in the case.
