Legal Question in Wills and Trusts in California

My parents purchased land with another couple in California. My dad passed away. Does my mother inherits his part of the property or is it divided equally amongst surviving owners? Also, what can we do to ensure that my mother's part of the property is left to my brother and I if my mother passes away?

Survivorship depends on how title is held. Assuming title was owned as community property, yes, your mother would own the entire one-half.

Your mother should consider some estate planning and consult with a local estate planning attorney. Probably the easiest way to ensure transfer of title is to place her interest in the property into a trust naming you and your brother beneficiaries when she passes.
