Legal Question in Wills and Trusts in California

Peremptory challenge to judge in probate

I am an attorney who is the current trustee for my deceased mother in law's trust. I was just served with a petition to remove me from the trust this morning. The hearing is scheduled before a judge that I had previously filed a complaint with the Commission on Judicial Performance. I can't stand this judge, and he can't stand me.

Can I file a 170.6 to a judge sitting in Probate?

Sounds appropriate to me. You might also file a 170.1(a)(6) motion.
