In a probate case what percentage of the sale of the homes (real estate) should the lawyer get? I mean how much does the lawyer get when you sell each house ?

It is not based on the sale of properties or anything else but the total value of the estate assets combined. There is a statutory fee schedule that the attorney must follow, unless there are unusual circumstances that make the statutory fee unreasonable, in which case the attorney may petition the court for adjustment. The statutory fee schedule can be found here: http://www.leginfo.ca.gov/cgi-bin/displaycode?section=prob&group=10001-11000&file=10810-10814
