Re: Sole Heir & Successor Trustee to Deceased Mother's Estate and Trust,

The house is registered in the name of my mothers Trust with the county recorder in the county where the house is situated.

Again the language is confusing because one does not register with the county recorder. I am assuming you mean that the deed recorded with the county recorder reflects that the owner owns it as Trustee of the Trust. If that is the case, one needs the Trust document to be reviewed to proceed. Hopefully it is in recordable form, otherwise without an abstract of trust being recorded, transfer will require a court order.

Again, contact an attorney who can assist you. If the trust is in recordable form or if there is a recorded abstract of trust it should be a no brainer, and no court action should be required.
