Legal Question in Wills and Trusts in California

After my stepmother died, my father married my stepsister. My father verbally promised me his gold record that he earned in the 60's, before he was married to my stepmother. Now I find it is not in his possession, but in my stepsister's son's possession. Stepsister claims my father gave it to him. My father suffers from memory problems due to a stroke and aging. Nothing is on paper, regarding the gold record. When he dies I am not interested in receiving any money nor any of his possessions, sans that gold record. What legal steps must I take to get it? My father is still alive at this time.

You must file a petition to be appointed his conservator and get a court order compelling step nephew to give it back to your father.
