marijuana dui

i know it's illegal to DUI on marijuana,

but how is it proven?

urine sample?

if so, doesn't a positive urine sample only indicate marijuana use within the previous few days/week, rather than while you were actually driving?

what's the story?

You are correct sir. DUI-MJ is difficult for the prosecution to prove under the current methods, a urine test. This is because it is not specific to a certain time and includes a large range of time. There is a rumor that cops will start testing blood when they suspect drugs, but that has not started yet.

The police could also have you submit to a Drug Recognition Exam. this is much like the roadside tests, but specific to drugs. Most officers are not trained as DRE, so they do not do these tests.

If you have a DUI-MJ, it is important to have an attorney that understands the issues specific to these cases. It is often necessary to have an expert discuss why the urine test means very little. Most courts will allow the test in and many jurors will not understand enough to know how little it means.
