me and my children fled are home and went to another state after a domestic violence incident in which he was arrested and I was given a restraining order now we want to move back into are home but he refuses to leave and give it back to us.what do I do?

There is only one way to return to the home without your husband. You need to file for divorce and ask the Court for an order granting you temporary possession of the home until permanent orders.
