Divorce

I have been married since 2005. My husband was deported and in a German Prison. He will never be allowed back in the United States. How can I obtain a divorce? We have never lived together nor have we owned anything together, there are no childre.. We married while he was in prison here in Colorado. The marriage was never consimated

You can obtain a divorce in Colorado by filing a Petition for Dissolution of Marriage. Your right to a divorce will not be affected by the fact that your husband is in Germany. However, this presents some tricky issues, because it will be difficult to serve him personally with the petition and other papers. You will need to use "substituted service", which means that you'll need to serve him by mail. I strongly recommend contacting an attorney at this point to discuss how to proceed.
