Legal Question in Family Law in Colorado

Hi,

Question: My sons mom called me this last week told me she is claiming my son on her taxes. when we did our parenting plan we agreed to every other year. If I claim him with out a 8338 form can I get in trouble? She has him most of the time. I pay support and have never been behind. Also can I hold her in contempt for not following our parenting plan?

Yes, if she is not following the court's order you may file a motion for contempt. I believe you may be the same individual that I responded to a little earlier.
