Legal Question in Civil Litigation in Colorado

Good Morning,

What kind of attorney do I go to when I have a conflict with the man I am living with over the proceeds from the sale of our house. Both of our names are on the mortg, but I have been paying the entire house payment for years. When the house sells I think he should reimburse me for his share. Do I go to a family Law atty? or what kind of atty, besides a GOOD ONE?

Thank you.

Lisa

This is a contract issue so any attorney who regularly deals with contract matters (can be a business attorney, real estate attorney, general practice attorney, so on) can assist you. This is not a family law issue unless you are married. Is the house already listed for sale?

Do you have any form of written agreement that would have addressed this issue and disputes? Are both of you on the deed or is only one person on the deed? The mortgage just relates to the debt and not ownership. Did you at least have an oral agreement on what you were both responsible for and what would happen if either side did not comply with that responsibility?

You need to speak with an experienced attorney so they can advise you and then try to come to a written agreement as soon as possible, especially if the home is listed.
