Legal Question in Insurance Law in Colorado

Long Term Disability Insurance

I had short term and long term disability insurance (even paid extra for better long term disability coverage) when I was laid off on March 18th of 2002. The company paid for my insurance for 6 months afterwards at which time it rolled over to Cobra Serve. I was disabled on March 18th by both the VA and Social security so why can't I get my disability benefits even though I didn't continue the insurance after the 6 months (couldn't afford it). I have been trying but I get ignored.

Re: Long Term Disability Insurance

It appears to me that you should have received benefits under the LTD policy if you made timely application. Did you apply and get a denial. Have you appealed a denial. If it is a ERISA plan, there are Federal procedures for what the disbility carrier must do. I am concerned that you became disabled in 2002 and timely application and appeal was not made. I suggest you review all the facts and the disability insurance contract with an attorney as soon as possible. If you have questions, feel free to email or call.

Re: Long Term Disability Insurance

I assume you mean you became disabled after you were laid off? Generally disability insurance ends on your last day of employment. The insurance you had through CobraServ was health insurance not disability.
