Legal Question in Landlord & Tenant Law in Colorado

I am a 67 year old disabled woman ( needing oxygen 24 hours a day) whose only income is my social security check of about $1200. I own a double-wide mobile home, but rent space in a mobile home park. Because of several severe financial problems in the last few months, I am unable to pay my lot rent of $736 which was due by November 5. In fact, my current bank balance is -$600, and I have no other assets or financial resources. I have received a notice from the park management that I must pay the rent due plus $50 late fee within 5 days (dated this past Monday) or I will be evicted. I read in the Colorado Revised Statutes that once the eviction prices is started I have 48 hours to remove my home from the park property.

I have no money to move my home or pay for another place to stay while I would try to sell my home, nor have I the physical means of packing my belongings. What can I expect to happen? Will they have the local police or sheriff physically remove me from my home? Can they lock me out of the home I own? Can they take possession of my home and personal property? This is all due to take place this weekend and I have no idea what to expect or do.

You have a little more time than you think, but not a lot. The 48 hours starts from when the judge enters the order of possession which won't happen until an eviction complaint is filed with the court and a hearing set. That will take at least a couple of weeks past the current notice.

Ultimately, a writ of restitution will be entered which will allow the property owner, with the assistance of the sheriff if necessary, to remove your property (including the mobile home) from the lot.

You need to try to find friends, family or a charity organization that might help you catch up your rent or move your property somewhere else so that you can keep it.
