Showing of a condo

Can a landlord show a condo to a possible tenant if there is already someone living there? The current resident has given a 30 day notice. The landlord has asked to show the condo to other people before she moves out. The resident is worried that people may see items in her house and break in knowing that the resident works nights.

Your lease governs this situation. If there is a provision in your lease then generally the landlord can show the property in a reasonable manner. For example with sufficient notice and during reasonable hours.

Regarding the issue of theft, unless the landlord is negligent I do not believe they can be responsible for any theft that occurs by a prospective tenant. However, many management companies require photo identification before showing the property. Find out if your management company requires identification and copies it. If they do not require identification ask that they require it or demand it and that they make a copy of the identification. Submit this request in writing and keep a copy. Then if something happens you have a list of suspects with their identification. If the identification is not faked. Also, put away anything that may be enticing to a thief.
