Legal Question in Wills and Trusts in Colorado

I am from Colorado. My father passed away. My aunt had power of attorney. There was no will in place. What do my sister and I need to do? Or can we do anything to put condo in our names, cars, etc? Thanks

I am sorry for your loss. If your father passed in Colorado, you need to open probate in the county where he passed. The power of attorney terminated on his death so that is irrelevant. If there is no will or other estate document (or alternative to estate documents such as POD or joint tenancy with right of survivorship), your father passed "intestate" which means that the assets pass to the beneficiaries as provided by statute.
