Legal Question in Wills and Trusts in Colorado

Prior to my father's passing, he had his bank accounts and house deed written to include my brother's name because my brother was living with him and I was living in another state. I am the eldest of the two siblings and I am in possession of a will stating that everything left was to be divided between my brother and I equally, but my brother claims that because his name is on the accounts and deeds, then everything is his, is this true?

Secondly, what about tangible objects of the estate and the possibility that my brother is selling them and depositing the money into the bank accounts? Is there any way to find out what money has been deposited into the bank accounts after my father passing?

Thank you, Mary

PS my father and brother live in Colorado and I live in California

Robert Murillo Pivotal Legal Ltd.

If the property was held in joint tenancy with right of survivorship with the brother and your father, he is right. The property is now entirely his. If the accounts were also joint or POD, the same thing.

Please hire a Colorado attorney and they can review all the relevant documents and give you advice.
