13 yr accuses 17 yr of forced oral sex

my 13 yr old step-daughter (who has been struggling with her parents divorce for over 2 yrs now & is in counseling) told a 13 yr old boy she wanted to have sex with him as she sent nude pictures to him on her cell phone & stated that her father beats her & her 16 yr old brother raped her 3 times. When we heard this, we called DCF & took her to the emergency room. She stated those things were lies, but her 17 yr old step-brother forced her to give him oral sex few months back. They made us take her to her mother's (father has custody) where her brother lives - leading us to believe they don't believe one thing but another. We are taking all the steps we have been asked to take. But what do we do for my son who states he didn't force her. What can happen to him? Should we be proactive & get legal counsel now or wait to see what happens? With the bitter divorce & history of animosity, I don't see this getting worked out easily.

If a 17 year old has sexual contact with a 13 year old, whether forced or not, it is second degree sexual assault (class B felony) with a minimum mandatory jail term of 9 months. Your son could be charged with a crime. Do you know whether anyone has been in contact with the local police or prosecutor's office?
