How do I change child support payments to be withdrawn from wages? Parent is current with child support. He doesn't owe me anything but I have to chase him down for it. I want it withdrawn from wages. Do I file a motion of contempt or a modification? I filed a motion of contempt even though he doesn't owe me back child support and I noted that. Did I file the wrong form? When we go to court will that negatively affect him?

The right way is to file a motion for order wage withholding. On your court date see if he will just agree to it. If so, write up an agreement and have the court make it an order. Then you have to go to the clerk's office and they will help you fill out the forms. If he won't agree, the court will most likely grant your motion.

Since you already have a court date you can just get an order for wage withholding when you are in court using the same instructions I have outlined above. I don't think he will be negatively affected by the motion for contempt.
